### Are noncompete agreements enforceable in Florida after the CHOICE Act?

Florida’s CHOICE Act, effective July 1, 2025, covers employees and contractors earning more than twice the annual mean wage in the relevant Florida county. It presumes noncompetes of up to four years are enforceable when its technical requirements are met, and it requires courts to grant a preliminary injunction on the employer’s application. Licensed healthcare practitioners are excluded and fall under Fla. Stat. 542.335. ### A former employee took my client list to a competitor. What can I do in Florida?

A client list can be a trade secret or confidential information if the company protected it. Options can include a demand to return the list, a contract claim, a trade-secret claim, and, where the facts support it, an emergency injunction. ### Can I get an emergency injunction to stop a former employee from competing in Florida?

Under the CHOICE Act, when a covered agreement meets the technical requirements, courts must grant a preliminary injunction on the employer’s application. Other noncompetes still require the employer to prove the usual injunction standards under Fla. Stat. 542.335.
